The Judicial system has the duty to enforce our rights. Laws have been created to keep the world from collapsing, and allowing mayhem to rule. Many persons and entities choose to approach life with an attitude of defiance to the norms. Here are a couple of examples of what you may encounter in your future business dealings. XM satellite radio cannot live without paying a visit to our judicial system. The Lanham Act protects against false advertisement, therefore XM is back in court. Mathew Enderlin claims that XM radio incurred “in false claims of free music with no advertisements.” This goes to show you that as a business you will be held accountable for false promises, the judicial system will not let it slide. All they need is an upstanding citizen to bring a claim before them and summary judgment will follow.
First let’s talk about the case of John Baxter against Rob Halford (Judas Priest front man), band members and new management. For over forty years he served as the acting representative in all dealings concerning Judas Priest front man. Mr. Baxter claims wrongful interference, with a breach of contract and alleged fraud. Baxter has sued Judas Priest Management team and other members of the band, because he has not collected any compensation since 1992 and was being misguided falsely by the defendant Mr. Halford.
A similar case dating back to 2010 occurred in the courts of Puerto Rico, which has a similar fact pattern related to contractual obligations and enforcement. The Latino music Hip Hop group ‘Calle 13’, where sued by their first acting manger José Luis Colón. Where he claims that a breach contract occurred when the Hip Hop group decided to part ways with him, because ‘they did not like Him’. Rene Perez Joglar alias Residente and his half brother Eduardo ‘Visitante’ Cabra parted ways with him claiming that they did not like his way of thinking and operating. So this unjustified firing has resulted in a $ 2,000,000.00 lawsuit against Calle 13.
As you have noticed in all three cases, different fact patterns took place, but in the end they all ended the same way. The guilty parties where held liable and where obligated to compensate the plaintiff in all three cases. This goes to show you that contracts in place, hold a lot more weight than people give them credit for. Enforce your right if you must, but abide by the contracts when you must do so. Lady Justice might be blind, but she can sure make you open your bank accounts up very swiftly and without hesitation.
